Lien Waiver

A signed document where the contractor waives the right to file a mechanic's lien on the customer's property in exchange for payment.

A lien waiver is the contractor's signed statement that, in exchange for receiving a particular payment, they waive their right to file a mechanic's lien against the customer's property for the work covered by that payment.

Conditional lien waivers are signed before payment clears (and become effective only when the payment actually clears). Unconditional waivers are signed after payment clears. Most general contractors and commercial customers require a lien waiver for every progress payment.
